The Land of Oz

And speaking of government jamming decisions down the throats of the American people:

Appeals court rules California's same-sex marriage ban unconstitutional

Think what you will about homosexual marriage, that "same-sex ban" came about in a popular referendum. The people of California (that "of the People, by the People, for the People" thing) decided to amend their constitution. The radically liberal 9th Circuit Court of Appeals has ruled that their successful effort was unconstitutional.

That's akin to spitting in the face of We the People.

So, if the people of, say, Mississippi, vote that black people can't own property, you would suggest that a court cannot overturn that?

Courts exist for a reason. they are another "check" in our system of governance.

Too bad courts didn't "check" a bunch of other stupid referendums passed by Cali voters over the years.

In the United States the people rule. Hilarious. In the United States the courts rule. Bugger the congress and the Constitution. But, Obama-ayers will save us. If he gets reelected, he'll declare himself President-for-Life.

Oh, Jerry, you're so yesterday. The concept of "sovereign state" and U.S. Constitution is history. Even a stellar member of the Supremes, Ruth Ginsberg says our Consitution is out-of-date not to mention Brennan who averred that we really should take foreign laws into consideration when making/deciding U.S. Law. Quaint old thangs like: "I,_______, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God. Plus, a 2nd oath: "I, etc., do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as Supreme Court Justice under the Constitution and laws of the United States. So help me God". Imagine anybody in our brave, new, improved modern world believing that....especially a wise Latina?

Ok - so this board favors raw democracy over representative democracy. Okey dokey. That clears everything up. Who needs a Constitution, balance of powers, federal system of government when you can do what folks on this board want to do, right?

I have occasionally written that I consider America to be at a point in time, what with our ability to communicate with one another so readily, for more of a referendum democracy.

Yeah, it would require a change in Constitution. But We the People need to take charge.

Have some faith in your fellow Americans. We'll be just fine.

Our Founding Fathers considered mass democracy - and rejected it for some very good reasons.

I think I heard it put best in the movie Men in Black.

Something along the lines of, "Person is a rational being who can be reasoned with. People is a mass of confusion and insanity."
